Terms of Service

These Terms of Service ("Terms") govern your access to and use of ADPulsify (also branded as Adpulsify.ai), operated by SikanSolutions ("SikanSolutions", "we", "us", or "our"), available at https://adpulsify.ai (the "Service").

By creating an account, connecting a social media account, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

If you do not agree to these Terms, you must not access or use the Service.

ADPulsify is a cloud-based platform that provides social media analytics, AI-assisted advertising creative tools, content publishing workflows, comment management, and related features for supported platforms including Facebook, Instagram, and TikTok.

Features may vary by subscription plan, connected platform, and account permissions granted through third-party OAuth authorization. We may add, modify, or discontinue features at any time.

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Service.

You must have valid accounts and legal rights to connect and manage any social media profiles, pages, or business assets you link to the Service.

You may not use the Service if you are prohibited from doing so under applicable law or if your account has been suspended or terminated by us.

You must provide accurate and complete registration information and keep it up to date.

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately at support@adpulsify.ai if you suspect unauthorized access.

We may suspend or terminate accounts that contain false information, violate these Terms, or pose a security risk.

Certain features require a paid subscription. Prices, billing intervals, and included features are displayed at checkout or on our pricing pages.

Payments are processed by Stripe or other authorized payment providers. By subscribing, you authorize recurring charges according to your selected plan until you cancel.

Subscriptions renew automatically unless canceled before the renewal date. You may cancel through account billing settings or by contacting support@adpulsify.ai.

We may offer free trials or promotional access. Trial terms, if any, will be disclosed at signup. We reserve the right to modify or discontinue trials at any time.

Except where required by applicable law, fees are non-refundable once a billing period has started.

The Service integrates with third-party platforms including Meta (Facebook and Instagram) and TikTok. Your use of those integrations is also subject to each platform's terms, developer policies, and community guidelines.

You are solely responsible for compliance with applicable platform rules, advertising standards, disclosure requirements (including sponsored content labels), and intellectual property rights when publishing or managing content through the Service.

We are not affiliated with, endorsed by, or sponsored by Meta, TikTok, or other social platforms except as necessary to provide authorized API integrations.

Platform APIs may change, become unavailable, or impose limits that affect Service functionality. We are not liable for interruptions caused by third-party platforms.

You agree not to misuse the Service. Without limitation, you must not:

• Violate any applicable law, regulation, or third-party rights.
• Upload, publish, or distribute unlawful, harmful, deceptive, defamatory, harassing, or infringing content.
• Use the Service to send spam, manipulate metrics, or engage in fraudulent activity.
• Attempt to gain unauthorized access to the Service, other accounts, or connected platforms.
• Reverse engineer, scrape, or circumvent security or rate limits except as permitted by law.
• Use the Service to collect or process personal data in violation of privacy laws or platform policies.
• Resell or sublicense the Service without our written consent.
• Use automated means to access the Service in a manner that burdens our infrastructure.

You retain ownership of content, prompts, creatives, and data you submit to the Service ("Your Content"), subject to licenses granted below.

You grant SikanSolutions a worldwide, non-exclusive license to host, store, reproduce, process, display, and transmit Your Content solely as necessary to operate, provide, and improve the Service and as you instruct (including publishing to connected platforms).

You represent that you have all rights necessary to submit Your Content and to authorize us to process connected social account data on your behalf.

The Service may generate images, text, or other materials using artificial intelligence based on your prompts and settings.

AI outputs may be inaccurate, incomplete, or unsuitable for your intended use. You are solely responsible for reviewing, editing, and approving all AI-generated content before publication or commercial use.

We do not guarantee that AI outputs will be unique, error-free, or free of third-party intellectual property claims. You assume all risk associated with use of AI-generated materials.

The Service, including software, design, trademarks, logos, and documentation (excluding Your Content), is owned by SikanSolutions or its licensors and is protected by intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes during your subscription or authorized access period.

If you provide suggestions, ideas, or feedback about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback without restriction or compensation.

Our collection and use of personal information is described in our Privacy Policy at https://adpulsify.ai/privacy. By using the Service, you consent to those practices.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that analytics or platform data will be complete or accurate. Social platform APIs and AI systems are outside our full control.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIKANSOLUTIONS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED EUROS (€100).

Some jurisdictions do not allow certain limitations of liability; in those cases, our liability is limited to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless SikanSolutions and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, your connected platform activity, or your violation of these Terms or applicable law.

We may suspend or terminate your access to the Service immediately if you breach these Terms, pose a security risk, or if required by law or platform policy.

You may stop using the Service at any time and may request account deletion by contacting support@adpulsify.ai.

Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (including payment obligations, disclaimers, limitations of liability, and indemnification) will survive termination.

We may modify the Service or these Terms at any time. Material changes to the Terms will be posted on https://adpulsify.ai/terms with an updated effective date.

Continued use after changes become effective constitutes acceptance. If you do not agree to modified Terms, you must stop using the Service.

These Terms are governed by the laws applicable in the jurisdiction where SikanSolutions is established, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence provide otherwise.

Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction, unless applicable law requires otherwise for consumers.

These Terms, together with the Privacy Policy and any order or plan-specific terms, constitute the entire agreement between you and SikanSolutions regarding the Service.

If any provision is found unenforceable, the remaining provisions remain in effect.

Our failure to enforce a provision is not a waiver of that provision.

You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
